Terms of Service for FestaLink

These Terms of Service ("Terms") govern your access to and use of the FestaLink web application and service (the "Service") available at https://festalink.com. Please read these Terms carefully.

By creating an account, making a purchase, or otherwise using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. The Service

FestaLink is a Software-as-a-Service (SaaS) that allows users to create animated virtual invitation cards for events, primarily children's parties. The Service includes the creation of an avatar, selection of a themed background, and compilation of event details into a shareable digital card.

2. User Accounts and Responsibilities

While no traditional user account is created, you are responsible for safeguarding the personal token provided to you upon successful payment. This token is the key to accessing the "Manage my card" page to edit or delete your invitation. You are solely responsible for any activities conducted using your personal token.

3. User-Generated Content and Conduct

You retain all rights to the content you create using FestaLink ("Your Content"). However, by using the Service, you agree that you will not create, upload, or share any content that:

  • Is illegal, offensive, defamatory, pornographic, or otherwise objectionable.
  • Infringes upon any third-party rights, including copyright, trademark, or privacy rights.
  • Contains malicious software or code.
  • Provides a link to a Google Maps location (or any other external link) that is fraudulent, malicious, or leads to harmful content.

You acknowledge and agree that FestaLink acts merely as a hosting platform for Your Content and assumes no responsibility or liability for any user-generated content. We reserve the right to remove any invitation at our sole discretion if we believe it violates these Terms.

4. Payment and Fees

  • The Service is offered for a one-time fee, displayed in Brazilian Reais (BRL).
  • Payment is processed securely by third-party gateways (Mercado Pago or Stripe). FestaLink does not store or process your payment card details.
  • All sales are final. Refunds will only be considered at our sole discretion in cases where the Service fails to function as described due to a fault on our part. Refund requests must be submitted via email to hello.festalink@gmail.com.
  • Please Note: As this is an MVP service operated by an individual, a formal fiscal invoice ("Nota Fiscal") will not be issued for purchases.

5. Service Availability and Data Retention

Your virtual invitation will be accessible via its shareable link until one day after the event date specified during creation. After this period, the invitation and all its associated data will be automatically and permanently deleted from our systems. This process is irreversible.

We do not guarantee uninterrupted or error-free service. The Service is provided on an "as is" and "as available" basis.

6. Intellectual Property

All rights, title, and interest in and to the FestaLink service (including the software, website, themes, designs, and branding) are and will remain the exclusive property of FestaLink and its licensors. The Service is protected by copyright and intellectual property laws.

7. Disclaimer of Warranties and Limitation of Liability

Your use of the Service is at your sole risk. The Service is provided "as is" without warranties of any kind, either express or implied.

To the fullest extent permitted by law, FestaLink shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service.

We are not responsible for the content of external links (such as Google Maps links) provided by users in their invitations. Users must trust the source of such links.

8. Indemnification

You agree to defend, indemnify, and hold harmless FestaLink and its operator from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including any copyright or privacy right.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions. Any legal disputes shall be resolved in the courts of Maceió, Alagoas, Brazil.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of changes by posting the new Terms on this page and updating the "Last Updated" date.
